1. Introduction

1.1 These Terms of Use (“Terms”) govern your use of the CwithAR platform and related services. CwithAR is operated by Teledomica Ltd (“Teledomica,” “we,” “us,” or “our”).

1.2 The CwithAR platform includes:

The CwithAR plugin or integration, which enables merchants to display 3D models of their products in augmented reality (AR) and extended reality (XR) devices through supported e-commerce platforms (such as Shopify, Wix, WooCommerce, or others).
The CwithAR XR app, which allows end-users to view 3D product models in mixed reality on supported XR headsets through their respective operating system or app stores.
The CwithAR mobile AR viewer, which enables models to be opened in a web browser via public links.
The CwithAR website (www.cwithar.com), which provides information, demo models, and pairing code functionality.

1.3 By accessing or using any part of CwithAR, you agree to comply with these Terms. If you do not agree, you must not use the plugin, the app, the website, or any related services.

1.4 These Terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Part A – Terms for Merchants (E-Commerce Platform Users)

2.1 Eligibility

Use of the CwithAR plugin or integration requires a valid account with a supported e-commerce platform.
Your use of that platform remains subject to its own Terms of Service, which govern merchant accounts, payments, and intellectual property.

2.2 Scope of Service

The integration provides functionality to display 3D models in AR and XR.
CwithAR does not process transactions, verify product details, or guarantee the accuracy of visualizations.

2.3 Data Handling

CwithAR does not create a merchant account with Teledomica.
We only collect:

A platform identifier or account reference to authenticate your use of CwithAR.
Model location information (links) required to deliver the 3D viewer.

We do not collect merchant names, payment details, or other personal information.

2.4 Data Retention

If you uninstall the integration or cancel your platform subscription, CwithAR will retain your model connection records for one month.
After one month, all associated records are permanently deleted and cannot be recovered.

2.5 Use of Public Links

Publishing a model through CwithAR generates a public link.
Public links may be shared or accessed outside your store or website.
While CwithAR does not provide a download button, advanced users may technically download the files.
You are fully responsible for the content you choose to publish, and Teledomica is not liable for unauthorized sharing, copying, or downloads.

2.6 Payments and Pricing

All billing and subscriptions are processed directly by your chosen e-commerce platform.
Teledomica does not process or store merchant payment details.
We reserve the right to change CwithAR pricing at any time without notice.

2.7 Termination and Misuse

Teledomica does not directly suspend or terminate merchants.
In cases of suspected misuse, abuse, or illegal content, Teledomica reserves the right to notify your e-commerce platform, which may take action under its own policies.

2.8 Updates and Modifications

The plugin and XR app may be updated at any time.
By continuing to use CwithAR, you accept any updates or modifications.

2.9 Disclaimer and Limitation of Liability

CwithAR is provided “as is,” without warranties of any kind.
Teledomica does not guarantee uninterrupted service, universal compatibility, or accuracy of product visualizations.
To the fullest extent permitted under UK law, Teledomica disclaims liability for lost sales, business interruption, or claims relating to merchant content.

3. Part B – Terms for Visitors (End-Users of AR and XR Apps)

3.1 Scope of Service

Visitors may view 3D models provided by merchants using the CwithAR mobile AR viewer or XR headset app.
No signup, login, or personal data entry is required.

3.2 Content Responsibility

All product models and related information are supplied by merchants.
Teledomica does not verify product content and is not responsible for its accuracy, completeness, or quality.

3.3 Safety Warnings

Users must remain aware of their surroundings while using AR/XR devices.
Teledomica is not responsible for injuries, accidents, or property damage that may occur during use.

3.4 Age Restrictions

The CwithAR XR app may only be used by individuals who meet the minimum age requirement of their XR headset provider (for example, Meta requires users to be 13+).
Parents and guardians are responsible for supervising underage users.

3.5 Disclaimer and Limitation of Liability

Visualizations are for reference only and may not precisely represent actual product size, color, or dimensions.
Teledomica is not responsible for purchase decisions or disputes between visitors and merchants.
To the fullest extent permitted under UK law, Teledomica disclaims liability for any damages resulting from use of CwithAR.

4. Part C – Terms for Website Visitors (www.cwithar.com)

4.1 Scope of Website

The website provides information about CwithAR, demo models, and pairing code functionality.

4.2 Acceptable Use

You may not use the website for unlawful, harmful, or disruptive purposes.
Automated data scraping, reverse engineering, or interference with website functionality is prohibited.

4.3 Content Responsibility

Demo content is for demonstration purposes only and may not represent actual products.
Teledomica is not responsible for reliance on demo materials.

4.4 Disclaimer and Limitation of Liability

The website is provided “as is” for informational purposes.
Teledomica is not liable for errors, downtime, or reliance on website content.

5. General Provisions

5.1 Amendments

Teledomica may revise these Terms at any time.
Posting the updated Terms online will constitute sufficient notice. Continued use of CwithAR after updates constitutes acceptance.

5.2 Third-Party Services

CwithAR relies on third-party platforms, including e-commerce platforms (e.g., Shopify, Wix, WooCommerce) and XR headset providers (e.g., Meta, Apple, Pico).
Your use of those services is governed by their respective Terms and Privacy Policies.
Teledomica is not responsible for the performance, availability, or policies of third-party platforms.

5.3 Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.
Disputes shall be resolved exclusively in the courts of England and Wales.

5.4 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full effect.
